MTX - User Agreement

Welcome to MTX! This User Agreement ("Agreement") is a binding legal agreement between you ("User," "you," or "your") and MTX ("we," "us," or "our"). This Agreement governs your access to and use of the MTX app, services, or website (collectively, the "Services"). By using the Services, you agree to be bound by the terms and conditions outlined in this Agreement. If you do not agree to the terms, you must not access or use the Services.

1. Use of the Services

1.1 Description of Services

MTX provides a digital asset platform that enables users to discover, track, and interact with digital assets. The Services include the MTX app, website, and other related tools and resources that allow users to connect their wallets, buy, sell, transfer, and store digital assets.

1.2 Eligibility

To use the Services, you must:

  • Be at least 18 years of age or the legal age of majority in your jurisdiction.
  • Have the legal authority to enter into this Agreement.
  • Comply with all applicable local laws, rules, and regulations regarding the use of the Services.

1.3 Account Registration

In order to access certain features of the Services, you may need to register an account ("Account"). By registering an Account, you agree to provide accurate, current, and complete information. You are solely responsible for the activity that occurs under your Account, including all transactions made using your wallet and credentials.

1.4 Account Suspension and Termination

MTX reserves the right to suspend or terminate your Account at any time if we suspect that you have violated this Agreement. If your account is suspended or terminated, you may not be able to access the Services or any associated features.

2. Digital Assets

2.1 Digital Asset Transactions

MTX facilitates the use of digital assets on the platform. However, MTX does not act as a broker, financial institution, or intermediary. You agree that all digital asset transactions are initiated and completed solely through the interaction between your wallet and applicable third-party protocols.

2.2 No Financial Advice

MTX does not provide investment, tax, or legal advice. All information provided by MTX is for informational purposes only and should not be construed as financial or investment advice. You are responsible for your own decisions regarding digital assets and any related transactions.

2.3 User Assets

You represent that you own or have the authority to use the digital assets in your wallet, and that these assets have been obtained legally. You also agree not to engage in fraudulent activity or use digital assets for money laundering or terrorist financing.

3. Fees and Payments

3.1 Service Fees

MTX may charge fees for using certain services or for specific digital asset transactions. The fees will be clearly displayed before you complete any transaction. You agree to pay all applicable fees, including network transaction fees ("Gas Fees").

4. Security

4.1 Your Responsibility for Account Security

You are solely responsible for maintaining the security of your account, including keeping your wallet and private keys safe. MTX will never ask for your private keys. If you believe your account has been compromised, you must notify us immediately.

4.2 Unauthorized Transactions

If you believe that an unauthorized transaction has occurred through your account, you must contact MTX Support immediately. While we may assist in investigating unauthorized transactions, we are not liable for any financial loss resulting from unauthorized access to your account.

5. User Conduct

5.1 Prohibited Activities

You agree not to:

  • Engage in illegal activities such as fraud, money laundering, or terrorist financing.
  • Attempt to manipulate markets, including "pump and dump" schemes, front-running.
  • Use the Services to promote or engage in any form of financial fraud.
  • Access the Services with the intention to harm, damage, or disrupt the platform or other users.
  • Violate any applicable laws or regulations when using the Services.

5.2 Consequences of Violation

If MTX determines that you have violated this Agreement, we reserve the right to suspend or terminate your account. You may also be subject to legal action based on the severity of the violation.

6. Data Protection and Privacy

6.1 Data Collection

MTX collects personal data necessary for your account registration, verification, and the provision of services. By using the Services, you consent to the collection, processing, and storage of your personal information in accordance with our Privacy Policy.

6.2 Security of Personal Data

MTX takes reasonable steps to protect your personal data and account information from unauthorized access. However, we cannot guarantee absolute security, and you are advised to take all necessary precautions to protect your account.

7. Dispute Resolution

7.1 Arbitration Agreement

By using the Services, you agree that any disputes between you and MTX will be resolved through binding arbitration. You waive your right to a jury trial or class action. Arbitration will take place in [Jurisdiction], and all decisions made by the arbitrator will be final and binding.

7.2 Reporting Issues

If you have a complaint or issue regarding the Services, you may contact MTX Support, and we will attempt to resolve the issue amicably. If the issue cannot be resolved through support, it will proceed to arbitration.

MTX reserves the right to modify or update this Agreement at any time. We will notify users of any changes, and your continued use of the Services after such changes constitute your acceptance of the updated Agreement.

9. Limitation of Liability

9.1 No Liability for Losses

MTX is not responsible for any loss or damage that occurs through the use of the Services, including financial losses or data breaches. The Services are provided on an "as is" basis, and MTX does not guarantee the performance of the platform.

9.2 Indemnification

You agree to indemnify and hold MTX harmless from any claims, losses, or damages arising from your use of the Services or violation of this Agreement.

10. Termination of Agreement

10.1 Termination by You

You may terminate this Agreement at any time by closing your account. However, any pending transactions or unresolved issues must be settled before termination.

10.2 Termination by MTX

MTX may suspend or terminate your access to the Services if we suspect any breach of this Agreement. Upon termination, any outstanding fees or obligations must be paid immediately.

11. Governing Law

This Agreement is governed by the laws of [Jurisdiction], without regard to conflict of law principles. Any disputes not resolved through arbitration will be resolved in the courts of [Jurisdiction].
